Assist trigger not working

the flow seems pretty straight forward but for some reason it isn't working. I have an s3 with the latest updates available

Can you select Automagic as the target app when you long-click the home button and select the magnifying glass at the bottom of the screen? Is a Google icon showing on the button in the middle?

Yup the Google icon is showing. And I don't have the magnifying glass when I long click the home button on my s3

Perhaps you have set to use Google as the default action for this button.
Try to reset the defaults by going into the settings of your device->Applications manager->ALL->Google Search->Clear defaults
The icon on the middle button should change to a magnifying glass and selecting the icon should show an application selection containing Automagic.
